TERMS OF USE

These Terms of Use ("Terms") govern access to and use of the Beep Beep mobile application, websites, audio experiences, navigation features, and related services (collectively, the "Service") offered by Hey Beep Beep Inc., a Delaware corporation ("Beep Beep," "we," "us," or "our"). By creating an account, downloading or using the Service, or clicking to accept these Terms, you agree to them. If you do not agree, do not use the Service.
1. Eligibility and family use
You must be at least 16 years old to create an account or use the Service. If the law where you live requires a higher minimum age to use a navigation or driving-related service, that higher age applies. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms for you where required by law.
The Service includes family-oriented experiences that may interact with vehicle occupants, including children. The account holder is responsible for supervising younger occupants, selecting appropriate experiences, providing any legally required notice or consent, and ensuring that no occupant independently controls the Service in an unsafe or unauthorized manner. If we reasonably believe an account holder is below the applicable minimum age, we may suspend or delete the account.
2. The Service
Beep Beep combines navigation-related information, location-aware audio, stories, points of interest, recommendations, interactive games, community comments, and other content. Some content may be created, summarized, personalized, or voiced using artificial intelligence. Features, coverage, accuracy, and availability may differ by location, device, plan, and release version.
The Service is an entertainment and trip-assistance product. It is not an emergency service, traffic-control authority, professional guide, or substitute for official road signs, law-enforcement instructions, emergency alerts, or safe driving judgment.
The Service may include a free tier supported by advertising, optional paid features or subscriptions, or both. An internet connection may be required. You are responsible for your device, mobile-data, messaging, roaming, and other connectivity charges.
3. Driving and safety
DO NOT INTERACT WHILE DRIVING. Set your destination and preferences before moving. A driver must keep attention on the road, obey all laws and signs, use hands-free controls where permitted, and stop safely before interacting with the Service.
Routes, arrival estimates, road conditions, closures, hazards, speed information, points of interest, accessibility details, operating hours, and story content may be incomplete, delayed, or wrong.
Never follow an instruction that appears unsafe, unlawful, inconsistent with road signs, or unsuitable for your vehicle, trailer, weather, road surface, or driving ability.
The Service does not contact police, fire, medical, roadside, or other emergency services. In an emergency, stop when safe and contact the appropriate emergency service directly.
You are solely responsible for your driving decisions, passengers, vehicle, route, parking, stops, and compliance with applicable law.
4. Accounts and security
An account is currently required to use the Service. You must provide accurate information, keep it current, protect your credentials, and promptly notify us at [SUPPORT EMAIL] of suspected unauthorized access. You may not share an account in a way that defeats plan limits or security controls. We may require identity, age, parental authorization, or payment verification where reasonably necessary.
5. Permissions and connected services
Certain features require device permissions or connections, including precise or background location, calendar access, notifications, microphone access, and analytics. You choose whether to grant optional permissions and may revoke them in device settings, although doing so may disable features. If you connect a third-party calendar, map, voice, payment, app-store, or other service, its terms and privacy practices also apply. You authorize us to access connected information only as described in the Privacy Policy and the permissions presented to you.
6. User submissions
You may be able to submit comments about locations or stops, ratings, corrections, recordings, text, feedback, photos, trip ideas, or other material ("User Content"). You retain ownership of your User Content. You grant Beep Beep a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, translate, moderate, adapt, display, distribute, and otherwise use User Content to operate, promote, secure, and improve the Service.
For comments, photos, and expressive submissions, the license generally ends when the content is deleted from the Service, subject to reasonable backup periods, legal retention, de-identified information, and copies already lawfully shared with others. Factual corrections, place attributes, map information, and similar contributions may be retained, combined with other sources, and incorporated into Beep Beep's location database after the original submission is removed. Beep Beep does not owe compensation or attribution for feedback, factual corrections, or suggestions unless separately agreed in writing.
You represent that you have the necessary rights and permissions for User Content and that it does not violate law, privacy, publicity, intellectual-property, or other rights. Do not record or submit another person without legally sufficient notice and consent. Do not submit sensitive personal information unless a feature expressly requests it.
6.1 Community comments and moderation
Community comments and other published submissions are not private. They may appear with your username, profile information, the relevant location or stop, and associated metadata described at submission. Do not include a child's personal information, another person's precise location, private contact information, or anything you would not want other users to see.
We may review, delay, reject, edit for format, limit distribution of, or remove User Content before or after publication. We do not guarantee that content will be published, remain available, be accurate, or be reviewed. You may report unlawful, unsafe, infringing, or otherwise prohibited content through support@heybeepbeep.com.
User Content may not be false, deceptive, defamatory, threatening, harassing, discriminatory, obscene, unlawful, promotional spam, dangerous, privacy-invasive, infringing, or designed to manipulate rankings or recommendations. It may not identify a minor or disclose another person's personal information without legally sufficient permission.
6.2 In-car voice interactions
The Service may use voice and audio features to interact with vehicle occupants, respond to commands, operate games, and evaluate whether an experience appears effective. The account holder must activate these features and notify occupants that an AI-enabled service may process their voices or other audio signals. Features that retain raw audio or analyze audio involving children beyond what is necessary to provide the immediate experience will require any separate parental consent and in-product disclosure required by law.
7. Acceptable use
You may not:
use the Service unlawfully, dangerously, fraudulently, or to harass, threaten, stalk, discriminate, or harm;
upload malware, interfere with security, overload systems, probe vulnerabilities, or bypass technical or geographic restrictions;
scrape, harvest, reverse engineer, decompile, copy, resell, frame, or commercially exploit the Service except where applicable law expressly permits;
submit content you do not have the right to use or attempt to identify individuals from de-identified data;
use the Service to train or benchmark a competing model or product without written permission;
misrepresent affiliation, impersonate others, or manipulate ratings, promotions, referrals, or advertising;
submit false location comments, fabricated place information, promotional spam, or content intended to create an unsafe stop or route; or
use community or voice features to collect, expose, or infer personal information about children or other occupants without legally sufficient permission.
8. Intellectual property
The Service, excluding User Content, is owned by Beep Beep and its licensors and is protected by intellectual-property laws. Subject to these Terms, Beep Beep grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for lawful, non-commercial purposes. No rights are granted by implication. "Beep Beep," associated branding, and product names are trademarks of Beep Beep or its licensors.
9. AI-generated and third-party content
AI-generated content may contain errors, invented details, outdated information, bias, or unsuitable material. Verify important facts independently. Historical, cultural, business, and destination information may reflect third-party sources and viewpoints and does not constitute endorsement. Third-party links, locations, products, advertisements, and services are provided for convenience; Beep Beep does not control or guarantee them.
10. Subscriptions, purchases, and trials
Paid features, prices, billing periods, renewal terms, taxes, trial conditions, and cancellation instructions will be shown before purchase. Unless stated otherwise, subscriptions automatically renew for the same period until canceled. Purchases made through Apple, Google, or another marketplace are billed and managed by that provider, and its payment, cancellation, and refund rules apply. For direct purchases, you authorize recurring charges to your selected method until cancellation.
Cancel before renewal through the place of purchase. Except where required by law or expressly stated at purchase, fees are non-refundable and partial periods are not credited. We may change prices prospectively after reasonable notice.
If you are an EEA consumer, mandatory consumer rights remain unaffected. Where you request immediate supply of digital content or services during a statutory withdrawal period, we will request any acknowledgment or consent required by law. Nothing in these Terms limits a right that cannot lawfully be waived.
11. Advertising and promotions
A free tier may display sponsored content, promotions, or advertising, while paid plans may provide additional features, reduced advertising, or other benefits described at purchase. We will seek consent where required before using device identifiers, precise location, or similar information for personalized advertising. Sponsored material will be identified where required. Promotions may have separate rules. You are not required to visit a promoted location, and safe driving considerations always control.
DO NOT VIEW OR SELECT ADS WHILE DRIVING. A driver must wait until safely stopped or have a passenger interact with advertising, offers, or promoted locations.
12. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It forms part of the Service disclosures but is not incorporated into these Terms to create contractual rights beyond applicable law. Review it before using the Service.
13. Suspension and termination
You may stop using the Service and request account deletion at any time. We may restrict, suspend, or terminate access if you breach these Terms, create legal or safety risk, fail to pay, misuse the Service, or if necessary to protect users, Beep Beep, or third parties. Where appropriate, we will provide notice and an opportunity to remedy. Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms.
14. Changes and availability
We may add, modify, suspend, or discontinue features. We do not promise that the Service will always be available, uninterrupted, secure, or compatible with every device. For material changes to these Terms, we will provide notice appropriate to the change and obtain consent when required. Continued use after the effective date constitutes acceptance where permitted by law.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BEEP BEEP AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT ROUTE, LOCATION, CONTENT, AI OUTPUT, AVAILABILITY, SAFETY, OR RESULTS.
These disclaimers do not exclude warranties or consumer protections that cannot be excluded under applicable law, including mandatory rights of consumers in Sweden and the EEA.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEEP BEEP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, GOODWILL, OR USE; OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM DISTRACTED, UNSAFE, OR UNLAWFUL USE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BEEP BEEP FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
The exclusions and cap do not apply to liability that cannot legally be limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
17. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Beep Beep and its affiliates, officers, directors, employees, and agents from third-party claims, damages, losses, and reasonable costs arising from your unlawful use, User Content, violation of these Terms, or infringement of another person’s rights. This section does not apply to Swedish or EEA consumers to the extent prohibited or inconsistent with mandatory consumer law.
18. Governing law and disputes
18.1 U.S. users
These Terms are governed by Delaware law, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs arbitration. Before filing a claim, each party will give written notice and attempt in good faith to resolve it informally for 30 days.
Except for eligible small-claims matters and requests for injunctive relief concerning intellectual-property misuse, any dispute between a U.S. user and Beep Beep will be resolved by binding individual arbitration administered by [AAA/JAMS] under its applicable consumer rules. Class, collective, consolidated, and representative proceedings and jury trials are waived to the extent permitted by law. Users may opt out by emailing support@heybeepbeep.com within 30 days after first accepting these Terms, stating their name, account email, and intent to opt out. Either party may bring an eligible individual claim in any small claims court of competent jurisdiction. If this arbitration provision is found unenforceable as to any other claim, that claim may be brought in any state or federal court of competent jurisdiction, subject to applicable consumer-protection and venue laws.
18.2 Sweden and EEA consumers
If you are a consumer resident in Sweden or another EEA country, these Terms do not deprive you of mandatory protections of your country of residence. You may bring proceedings in courts available under applicable consumer law. Nothing in the U.S. arbitration clause applies where it would restrict those mandatory rights. Swedish consumers may also contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), subject to its eligibility rules.
19. General
These Terms and any additional terms presented for a feature form the entire agreement concerning the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Our failure to enforce is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law, subject to applicable rights. Headings are for convenience. Electronic communications and signatures satisfy writing requirements where lawful.
